Cincinnati Lawyer says No Such Thing As a Settlement Injury Formula

There is no such thing as a settlement injury formula. Many lay people think there is a settlement injury formula for their personal injury claim. This is fostered by so called self help books that tell you not to hire an attorney. I recently downloaded one of those “Settle my own Car Accident Case Books” and it gave a formula of 2,3,4 times your medical bills plus your lost wages.

 The fallacy of this can easily be recognized by the exampe of a person who had to have their leg amputated in a car accident. Let’s assume the following: the amputation occured the day of the accident , they had a desk job and were able to go back to work in 3 months, they were an avid competitor in marathon racing, golfing, tennis and iron man events. Their total medical bills were $125,000 and the medical providers accepted as full payment $75,000 to wipe out those bills. Lost wages were $15,000. So 3 times the $75,000 plus their lost wages is $240,000.

 This is wholly inadequate , in my opinion to receive as compensation for past and future pain, suffering, disfigurement and loss of enjoyment of life past and future. I would argue for $750,000-$1,000,ooo in the Cincinnati area. This amount still does not come close to making one whole for the loss of a leg . But in the past Hamilton county juries have been on the lower end of verdicts in Ohio as compared to Cleveland. ALTHOUGH THIS APPEARS TO BE CHANGING.

  The place of injury must be factored in, since the geo location will cause the amount of payment to be on the low and or the higher end. For instance John Hochenfelder publishes some verdicts out of  New York regarding  amputation

But New York’s verdicts are generally higher than Ohio’s and parts of New York are higher than others. That’s one of the reasons in serious injury cases you want to hire an attorney with significant personal injury experience. Cincinnati Attorney Reveals You Can Have A Personal Injury and Workers Compensation and Social Security Claim At the Same Time

How To Settle Your Own Injury Claim Yourself Book Review

There are some web sites that tout books variously titled How To Settle Your Own Personal Injury Claim Yourself. You can pay up to $100 dollars for some of these books. I wanted to see if they were selling snake oil to the consuming public. Yes and No is the answer. The book I reviewed is by an lawyer. It does give some educational material about the claims process. So its not ALL snake oil.

But their guarantee says it all. (Snake Oil) The say you will save as much or more as the price you pay for the book. Read even further and they tell you Amazingly the way they say you will save this money is by getting an insurance quote through an aggregator. So all your personal information is now captured by third parties. And they say get a quote two months after your settlement. If your insurance company raises your rates (which they should not do because we are presuming a not at fault accident) you can use this information to tell them you can get a better rate and if they do not lower your rate you can buy other insurance. So their guarantee has nothing to do with saving money on your settlement.

Not all cases need attorneys. Most real lawyers I know will tell you this without selling the information to you. Small cases can be handled by yourself. In fact, most serious personal injury attorneys limit the cases they take to serious injuries. Guess what the book says about that. “Please do not try to settle your case if you have a serious injury, a fatal injury , a brain injury or a permanent injury.”

They go on to say, “Injury lawyers have their place. There is no question about it. Good attorneys can increase your settlement substantially. There are certain claims where you NEED TO HIRE AN ATTORNEY i.e. brain injururies, permanent injuries, fatalities…. on these claims a lawyer is needed and the fee they charge (normally 33 1/3%) is well worth it.”

Well well well. In a book touting “settle your claim yourself” comes out the reality they tell you themselves. If you have a significant injury hire a personal injury lawyer.
I’ll have more to say about this book in the future.
I believe based on my experience their discussion of Colossus, the computer program started in use to value claims by Allstate in the United States is also not totally correct.

My Child Injury How To Avoid It

There is nothing worse than your child suffering an injury. This is especially true when it could have and should have been prevented. The American association for justice has recently commented on toy hazards that manufacturers could have prevented.
“Unforeseen hazards are still finding their way into toys despite recently improved safety standards, illustrating the need for a strong civil justice system that protects children and holds negligent manufacturers accountable, according to a new report released today by the American Association for Justice ”

For years, corporations have knowingly shipped toys with hidden dangers like small parts, loose magnets, asbestos, and other toxic chemicals until outrage from parents and civil actions forced regulators or manufacturers to act. As toys have become more sophisticated, so too have the risks associated with them,” said AAJ President Gibson Vance. “Protecting our children requires vigilance from everyone. Regulators, parents, manufacturers, and the civil justice system all play a part in keeping dangerous toys off store shelves.”
Information revealed by the Association is shocking. Its hard to believe for some this happens right here in Cincinnati or an town in America.

For example, earlier this year unsafe levels of cadmium were found in children’s jewelry, a toxic metal known to cause cancer and ranked as seventh on a federal list of the 275 most hazardous substances. An investigation found the origin of the metal was likely China, where the use of the toxin had been prompted, ironically, by the recent prohibition of using lead. The U.S. imports more than 30,000 tons of toys every year from foreign markets, accounting now for 95 percent of toys sold in the U.S.
